By purchasing this ticket, you are hereby agreeing to the following terms and conditions set forth by CM4M and its partners:
This Agreement (“Agreement”) is entered into by and between Cleveland Moms 4 Moms, a 501(c)3 Non-Profit organization, EIN 933954818 and having its registered address at Cleveland, OH and you (“User”) (which unless repugnant to the context and meaning thereof include your heirs, executors, administrators, successors and/or permitted assigns) and is made effective as of the date of your acceptance.
WHEREAS
between Cleveland Moms 4 Moms owns and operates “https://clevelandmoms4moms.org/” and associated product websites which is a web-based platform or service providing an online presence to the User.
This Agreement sets forth the general and specific terms and conditions of your use of the Site and the products and services offered by
Cleveland Moms 4 Moms through this Site (hereinafter collectively referred to as “the Services”);
The User is desirous of availing of the Services on the terms and conditions herein contained;
NOW, THEREFORE, in consideration of mutual agreements, covenants, representations and warranties set forth in this Agreement, and for other good and valuable consideration, the sufficiency and adequacy of which is acknowledged by the Parties, the Parties hereby agree as follows:
EXPRESSIONS
The terms “we”, “us” or “our” shall refer to Cleveland Moms 4 Moms.
The terms “you”, “your”, “User” or “customer” shall refer to any individual or entity who accepts this Agreement, has access to your account or uses the Services. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
REPRESENTATIONS
Users must be eligible and competent to enter into a contract under the applicable laws in order to use this site and its services.
The terms “you,” “your,” “User,” or “customer” refer to the corporate entity on whose behalf you are entering into this Agreement if you are a consumer. If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the authority to bind that corporate entity to the terms and conditions contained in this Agreement.
You have the legal authority to bind such corporate entity, as implied by your electronic acceptance of this Agreement. The obligations in this Agreement, including but not limited to the payment obligations, will be your personal responsibility if you don’t have the required authority.
YOUR OBLIGATIONS
You are solely responsible for the activity that occurs on your Account, whether authorized by you or not, and you must keep your Account information secure, including without limitation your customer number/login, password, Payment Method. For security purposes, Cleveland Moms 4 Moms recommends that you change your password at least once every three (3) months for your Account.
You are accountable for the caliber and/or quantity of the goods and/or services you supply, and you must hold us harmless from any loss resulting from any claim, demand, or other legal action based on any shortcoming in the goods and/or services you provide.
If any person requests a refund of the amounts they paid, you are responsible for covering that cost and keeping us protected from any loss brought on by a claim, demand, or other action arising out of that claim.
Any time your account is misused or there is a security breach, you must notify Cleveland Moms 4 Moms right away. In the event that your account is used without your permission, Cleveland Moms 4 Moms is not responsible for any losses you sustain. However, regardless of whether the loss was brought on by your Account by you, an authorized person, or an unauthorized person, you might be held responsible for it, Cleveland Moms 4 Moms or another party’s losses.
ACCESS TO WEBSITE/SERVICES
The Site may occasionally become unavailable or unusable for any reason, including but not limited to equipment failures, routine maintenance, repairs, or replacements we carry out from time to time, errors or issues with third-party software or service providers used by Cleveland Moms 4 Moms, or factors
beyond our reasonable control or things that are not reasonably foreseeable, such as interruption or failure of telecommunication or digital transmission. You acknowledge and agree that we have no control over the continuous or uninterrupted availability of this Site or the Service and that we are not liable to you or any other party in connection therewith.
GENERAL RULES OF CONDUCT
By using this Site and the Services, you agree to abide by this Agreement as well as all applicable local, state, national, and international laws, rules, and regulations. This includes any content you submit. In addition, you agree that you won’t use this website or its services in the following ways, as determined by Cleveland Moms 4 Moms in its sole discretion:
Results in the gathering or harvesting (or allowing someone else to gather or harvest) any User Content (as defined below) or any non-public or personally identifiable data about another User or any other person or entity without that person’s express prior written consent.
Infringes on the intellectual property rights of another user or any other person or entity; breaches any duty of confidentiality that you owe to another user or any other person or entity; promotes, encourages, or engages in terrorism, violence against people, animals, or property; promotes, encourages, or engages in spam or other unsolicited bulk email; hacks or cracks computer systems or networks.
interferes with the functionality of this website or the services available on it.
contains or installs any malware—such as worms, bugs, Trojan horses, or other types of code, files, or programs—that is intended to interfere with the operation of any software or hardware, damage it, or restrict its functionality.
Contains false or deceptive language, or unsubstantiated or comparative claims, regarding Cleveland Moms 4 Moms ’s Services.
It is further agreed that: Except as expressly permitted by Cleveland Moms 4 Moms you will not copy or distribute in any format any part of this Site or the Services.
You will only use this Site or other methods that Cleveland Moms 4 Moms may designate to access Cleveland Moms 4 Moms Content (as defined below) and User Content.
You consent to make a complete backup of all your User Content so that you can access and utilize it as needed. You agree to assume the risk of losing all your User Content because Cleveland Moms 4 Moms makes no guarantee that it backs up any Account or User Content.
When requested, you agree to present government-issued photo identification as well as/or business identification as needed for identity verification.
You understand that Cleveland Moms 4 Moms may occasionally call you regarding your account and that you have no reasonable expectation of privacy during any such call(s). In fact, you hereby consent to allow Cleveland Moms 4 Moms, in its sole discretion, to record the entirety of such calls, whether Cleveland Moms 4 Moms specifically asks for your consent to record a particular call. You further acknowledge and agree that any such recording(s) may be used as evidence in any legal proceeding in which Cleveland Moms 4 Moms is a party, to the extent permitted by applicable law.
Any aspect of this site or the services, including without limitation prices and fees for the same, may be modified, changed, or discontinued at any time by Cleveland Moms 4 Moms.
You hereby agree not to bypass, disable, or otherwise tamper with any security-related features of this Site or the Services made available at this Site, including without limitation any features that forbid or restrict the use of, or the copying of, any Cleveland Moms 4 Moms Content or User Content, or that impose restrictions on the use of this Site or the Services made available at this Site, the Cleveland Moms 4 Moms Content or the User Content therein.
By participating in the CM4M Mother’s Day event, you agree that CM4M management bears no responsibility for any remarks or actions during the event that may be interpreted as hurtful or vulgar. This event is designated as an adult women’s party, and all participants are expected to engage in healthy fun while maintaining respectful and kind interactions with one another.”

Except for User Content, the information on this site and its services (collectively, Cleveland Moms 4 Moms Content”) is owned by or licensed Cleveland Moms 4 Moms in perpetuity and is protected by copyright, trademark, and/or patent laws. Cleveland Moms 4 Moms Content includes, but is not limited to, text, software, scripts, source code, API, graphics, photos, sounds, music, videos, and interactive features. For your information and personal, non-commercial use only, Cleveland Moms 4 Moms Content is made available to you “as is,” “as available,” and “with all faults.” It may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise used for any purpose whatsoever without the express prior consent of Cleveland Moms 4 Moms Cleveland Moms 4 Moms Content for personal, non-commercial purposes and for informational purposes. It may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited without the express prior written consent of Cleveland Moms 4 Moms. User Content:
Users may view, post, publish, share, store, or manage (a) ideas, opinions, recommendations, or advice (“User Submissions”) while using this site or the services, or (b) literary, artistic, musical, or other content, including but not limited to photos and videos (collectively with User Submissions, “User Content”). Forum posts, content submitted for a contest, product reviews or recommendations, and photos to be used in social media events or activities are all examples of user submissions. All content posted through your Account is considered User Content. RESPONSIBILITY OF USER CONTENT

USER SUBMISSIONS

All your user submissions are completely optional.
Your User Submissions do not bind Cleveland Moms 4 Moms to keep your User Submissions private or confidential, and they do not create a confidential relationship.
Neither you nor anyone else is entitled to compensation for any intentional or unintentional use of your User Submissions. Cleveland Moms 4 Moms is under no express or implied obligation to create or use your User Submissions.
Cleveland Moms 4 Moms might be working on the same or related content, it might be aware of such content from other sources, it might simply want to create this (or related) content on its own, or it might have taken or will take some other action.
Cleveland Moms 4 Moms shall own exclusive rights (including all intellectual property and other proprietary rights) to any User Submissions posted to this Site and shall be entitled to the unrestricted use and dissemination of any User Submissions posted to this Site for any purpose, commercial or otherwise, without acknowledgment or compensation to you or to anyone else.
WITH RESPECT TO USER CONTENT (OTHER THAN USER SUBMISSIONS)
You will continue to hold all ownership or license rights in any websites or other content that are hosted by Cleveland Moms 4 Moms.
You grant Cleveland Moms 4 Moms permission to use the intellectual property and other proprietary rights in and to your User Content for the purposes of enabling inclusion and use of the User Content in the manners contemplated by this Site and this Agreement by posting or publishing User Content to this Site or through the Services. You hereby grant Cleveland Moms 4 Moms a non-exclusive, worldwide, sublicensable (through several tiers), and transferable license to use, reproduce, distribute, create derivative works from, incorporate into other works, display, and perform your User Content in connection with this Site, the Services, and Cleveland Moms 4 Moms ‘ (and Cleveland Moms 4 Moms ‘ affiliates’) business(es, including without limitation for marketing and redistributing all of the Services.
Additionally, you hereby grant a non-exclusive license to each User of this Site to access (with the exception of “private” or “password protected” User Content) and use, reproduce, distribute, create derivative works of, incorporate into other works, display, and perform your User Content in accordance with the functionality of this Site and this Agreement. MONITORING OF CONTENT
Whether it is posted to this Site or one of the websites it hosts, Cleveland Moms 4 Moms typically does not pre-screen user content before it is published. The choice of whether any piece of User Content is appropriate and/or complies with this Agreement rests with Cleveland Moms 4 Moms, who does so without any obligation. For posting or publishing any material in violation of this Agreement, or for any other violation of this Agreement (as determined by Cleveland Moms 4 Moms in its sole and unfettered discretion), Cleveland Moms 4 Moms may remove any item of User Content (whether posted to a website hosted by Cleveland Moms 4 Moms or posted to this Site) and/or terminate a User’s access to this Site or the Services found at this Site at any time.
ADDITIONAL RESERVATION OF RIGHTS
For any reason (as determined by Cleveland Moms 4 Moms in its sole and absolute discretion), including but not limited to the following, Cleveland Moms 4 Moms expressly reserves the right to refuse, cancel, terminate, suspend, lock, or modify access to (or control of) any Account or Services. (i) to protect the integrity and stability of any domain name registry and correct errors made by that registry; (ii) to help with our efforts to detect and prevent fraud and abuse; and (iii) to comply with court orders against you and/or your domain name or website as well as applicable local, state, national, and international laws, rules, and regulations.
The right to review each Account for excessive space and bandwidth usage and to terminate or charge more for those Accounts that do so is expressly reserved by Cleveland Moms 4 Moms.
Any and all Services may be terminated by Cleveland Moms 4 Moms without prior notice if, in Cleveland Moms 4 Mom’s sole discretion, you are harassing or threatening any person.
For technical purposes, including but not limited to maintenance, software updates, managing plug-ins, taking backups, and managing security and privacy, Cleveland Moms 4 Moms expressly reserves the right to access your site and suspend services provided to the US without prior notice to you.
SPAM
We reserve the right to redirect, suspend, or terminate any account, website hosting, domain registration, email boxes, or other applicable products or services if we determine that the account, products, or services in question are being used in connection with spam. In this case, at our discretion, we may request that you email us back pledging that you will stop sending spam and/or paying someone else to send spam on your behalf. We may also request that you pay a non-refundable reactivation fee before the site, email boxes, and/or services are reactivated.
Unsolicited Commercial Email (UCE), Unsolicited Bulk Email (UBE), and Unsolicited Fax (Fax) are all examples of spam, which is defined as the sending of email or fax to recipients without first obtaining their prior, verified consent to receive these communications. For an email address or fax number, conclusive proof of opt-in may be required upon our request.
All of our clients and recipients of emails sent using our products and services are urged to report any suspected spam.
It is acknowledged that we may immediately close any Account that, in our sole and absolute discretion, we believe to be sending spam or other unsolicited bulk email or to be otherwise associated with such activity. Additionally, you agree to pay us liquidated damages in the amount of Rs. 10/- for each piece of spam or unsolicited bulk email sent from or otherwise connected to your Account if actual damages cannot be reasonably calculated.
LINKS TO THIRD-PARTY WEBSITES
Links to websites owned or controlled by third parties that are not Cleveland Moms 4 Moms may be found on this website and in the services offered there. When it comes to the terms and conditions, privacy policies, or other policies of any third-party websites, Cleveland Moms 4 Moms disclaims all liability. Additionally, none of the content on any websites run by third parties is censored or edited by Cleveland Moms 4 Moms. You expressly release Cleveland Moms 4 Moms from any and all liability arising from your use of any third-party website by making use of this Site or the Services offered on this Site. Assumption of Risk: You acknowledge and understand that participation in the event may involve certain risks, including but not limited to the risk of injury, falls, or accidents. You voluntarily assume all such risks associated with your participation in the event.
Release of Liability: You hereby release, waive, discharge, and covenant not to sue CM4M, its partners, organizers, sponsors, or any affiliated individuals or entities (collectively referred to as “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you during or as a result of your participation in the event.
Indemnification: You agree to indemnify and hold harmless the Released Parties from and against any claims, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to any injury or damage suffered by you or any third party as a result of your participation in the event.
Responsibility for Personal Safety: You are responsible for ensuring your own personal safety during the event. You agree to abide by all safety guidelines, rules, and instructions provided by CM4M and its partners, and to use any provided safety equipment appropriately.
No Guarantee of Safety: While CM4M and its partners will make reasonable efforts to provide a safe environment for the event, they cannot guarantee your safety or prevent all accidents or injuries. You participate in the event at your own risk.
Modification of Terms: CM4M and its partners reserve the right to modify or amend these terms at any time without prior notice. Any such modifications shall be effective immediately upon posting on the platform or other relevant channels.
By purchasing this ticket, you acknowledge that you have read, understood, and agreed to all the terms and conditions outlined above, including those related to liability issues. If you do not agree with any of these terms, please refrain from purchasing the ticket and participating in the event.
Protection of Personal Property: You understand and acknowledge that CM4M and its partners cannot guarantee the security of personal belongings or property brought to the event venue. You are solely responsible for safeguarding your own belongings and valuables.
Disclaimer of Liability for Theft or Loss: CM4M and its partners shall not be held liable for any theft, loss, damage, or disappearance of personal property, including but not limited to wallets, purses, electronic devices, clothing, or any other items, occurring during the event.
Indemnification: You agree to indemnify and hold harmless CM4M and its partners from and against any claims, damages, liabilities, costs, and expenses arising out of or related to the theft, loss, or damage of your personal property during the event.
Precautionary Measures: You are encouraged to take precautionary measures to secure your belongings, such as utilizing lockers or keeping valuables in a safe and secure location. CM4M and its partners may provide certain security measures, but these are not guaranteed to prevent theft or loss.

By purchasing this ticket, you acknowledge that you have read, understood, and agreed to all the terms and conditions outlined above, including those related to theft or loss of property. If you do not agree with any of these terms, please refrain from purchasing the ticket and participating in the event.
Healthcare Disclaimer for Party Attendees:
Health Risks Acknowledgment: By attending this party event hosted by CM4M, you acknowledge and understand that participating in social gatherings, especially those involving large crowds, may pose health risks, including but not limited to exposure to contagious diseases such as COVID-19.
Personal Health Responsibility: You agree to assess your own health status before attending the event. If you are experiencing any symptoms of illness, including fever, cough, sore throat, or difficulty breathing, or if you have been in contact with someone who has tested positive for a contagious disease, you must refrain from attending the event for the safety of yourself and others.
Health Guidelines Compliance: You agree to comply with all health guidelines and recommendations provided by local health authorities and event organizers to reduce the risk of spreading contagious diseases. Assumption of Risk: You acknowledge that despite the implementation of precautionary measures, attending a party event involves inherent risks to your health and wellbeing. You voluntarily assume all such risks associated with attending the event and agree not to hold CM4M, its partners, organizers, or affiliates liable for any illness or injury that may occur as a result of attending the event.
Liability Waiver: To the fullest extent permitted by law, you waive any claims or causes of action against CM4M, its partners, organizers, or affiliates arising out of or related to any illness, injury, or other health-related issues that may arise from attending the party event.
Healthcare Consultation: If you have any concerns about your health or potential risks associated with attending the event, it is recommended that you consult with a healthcare professional before making a decision to attend.

Acknowledgment of Party Nature: You understand and acknowledge that the event organized by CM4M is a party event, which may involve music, dancing, socializing, and other activities typically associated with such events.
Responsibility for Conduct: You agree to conduct yourself responsibly and respectfully during the event. You will not engage in any behavior that may cause harm to yourself, others, or the venue, including but not limited to excessive intoxication, disruptive behavior, or illegal activities.
No Liability for Participant Conduct: CM4M and its partners shall not be held liable for any actions, behaviors, or conduct of participants during the event. Each participant is responsible for their own actions and consequences thereof.
Alcohol and Substance Use: You understand that alcoholic beverages and other substances may be available or consumed during the event. You acknowledge that the consumption of alcohol or substances is at your own risk and that CM4M and its partners shall not be held liable for any resulting harm or consequences.
Safety Precautions: CM4M and its partners will make reasonable efforts to ensure the safety and security of all participants during the event. However, you acknowledge that participation in a party event carries inherent risks, and you agree to exercise caution and discretion at all times.

Behavior Disclaimer for Party Attendees:
Conduct Expectations: By attending this party event hosted by CM4M, you agree to conduct yourself in a respectful and responsible manner at all times. Disruptive behavior, harassment, violence, or any other actions that may cause harm, discomfort, or inconvenience to others will not be tolerated. By participating in the CM4M Mother’s Day event, you agree that CM4M management bears no responsibility for any remarks or actions during the event that may be interpreted as hurtful or vulgar. This event is designated as an adult women’s party, and all participants are expected to engage in healthy fun while maintaining respectful and kind interactions with one another.”
Respect for Others: You agree to respect the rights, opinions, and boundaries of other attendees, regardless of differences in background, culture, or beliefs. Discriminatory, derogatory, or offensive language or behavior will not be tolerated.
Alcohol and Substance Use: If alcoholic beverages or other substances are available at the event, you agree to consume them responsibly and in accordance with the law. Excessive intoxication or impaired behavior that endangers yourself or others will not be tolerated.
Safety Awareness: You acknowledge the importance of maintaining a safe environment for all attendees. Any behavior that compromises the safety or security of the venue, property, or individuals will not be tolerated.
Compliance with Laws and Regulations: You agree to comply with all applicable laws, regulations, and venue policies while attending the event. Any illegal activity or violation of rules may result in removal from the premises and may be reported to the appropriate authorities.
Accountability for Actions: You understand that you are solely responsible for your own actions and behavior during the event. CM4M, its partners, organizers, or affiliates shall not be held liable for any consequences arising from your actions, including but not limited to legal, financial, or reputational repercussions.
Consequences of Violations: CM4M reserves the right to take appropriate action, including but not limited to removal from the event premises, revocation of event privileges, or banning from future events, in response to any violations of this behavior disclaimer.

Ticket Unavailability Disclaimer:
Limited Availability: Please note that tickets for this event hosted by CM4M are subject to availability and may sell out quickly. We cannot guarantee the availability of tickets at any given time.
No Guarantees: While we strive to provide ample opportunities for attendees to purchase tickets, factors such as venue capacity, demand, and other logistical considerations may impact ticket availability.
First Come, First Served Basis: Tickets are sold on a first-come, first-served basis. Once tickets are sold out, no further tickets will be available for purchase, and entry to the event may not be possible without a valid ticket.
No Reservations: We do not offer ticket reservations or holds. All ticket purchases must be made through the designated ticketing platform or authorized ticketing outlets.
